Mandatory employment agreements with work permits and declaration of entrusting work becoming more certain

The government is planning changes to the employment of foreigners in Poland. The changes are to limit the forms of contracts which are the basis for employment with foreigners, including the issuing of:

  1. work permits only for employees employed on the basis of an employment basis*, including a temporary work contract
  2. declarations on entrusting work to a foreigner employed solely on the basis of an employment contract

*employment basis may be established on the  grounds of: employment contract, appointment, election, designation, cooperative employment contract. However, contracts of mandate are not included in this catalogue.

Differences in the planned regulations

It is worth highlighting the distinction used by the government in its work:

  • Declarations on entrustuing work are to be narrowed down to employment contracts only,
  • Work permits will be subject to a broader catalogue – the employment basis.

The exception. A contract of mandate would remain an acceptable form of employment for seasonal work.

From when will the new rules apply?

According to the government’s assumptions, the changes are to come into force as early as 1 January 2025.
