The President signed an amendment to the Act on Aid to Ukrainian Citizens in connection with the armed conflict on the territory of Ukraine and certain other acts. The amendment contains important issues concerning the legality of work and residence of Ukrainian citizens in Poland, and we would like to share this with you. The amendments include:
- extending the legal stay of Ukrainian citizens until 30 September 2025;
- extending temporary protection to underage children of Ukrainian citizens and underage children of spouses of Ukrainian citizens;
- application for PESEL number, Ukrainian citizens must submit it immediately (previously it was 30 days after arrival in Poland);
- access to the labour market in terms of:
• shortening from 14 to 7 days the deadline for sending a notification on the entrustment of work by an employer employing a Ukrainian citizens,
• the introduction of the necessity of submitting another notification on the employment of a Ukrainian citizens in the case when the type of contract between the entity entrusting the performance of work and the Ukrainian citizen has changed, the position or type of work performed has changed, the working time or the number of working hours per week or month specified in the notification has been reduced, the monthly or hourly rate of remuneration specified in the notification has been reduced,
• introduction of a requirement to indicate in the notification of employment of a Ukrainian citizens at least the minimum wage for work or the minimum hourly rate,
• the introduction of an obligation for a Ukrainian citizens to notify their employer of the delivery of a decision on granting a temporary residence and work permit within 7 days of the delivery of the decision; - allowing applications for family reunification for Ukrainian citizens without having to fulfil the mandatory requirements for other foreigners.
